Hello,

This is VCPD High Command and we thank you for making the report! We will open investigation to the matter and have the officer post their side of the story in here.

The other officers present on scene can also post their side on the matter as evidence shows multiple officers at the scene.
Nigga you flip sides so much you might aswell be a f**king pancake; one week you're in a crime family, then the next one you apply for VCPD.
Untrustworthy, unhelpful, and simply quite a pain..

the moral of the story : I went with goura to shacks after ghiless had found the crate on it I go there and I found Klaus and ghliess here I told Klaus to go leave this area but he did not and he shows that he was confused about what in the crate or what these things? I ordered him to leave this area but he did not so i /sus him for trying to pick illegal things after I sus him I used /sur and officer hezzy told him to surrender he did not then I say a chainsaw in his hand and he switched fast to shout gun but I noticed it that he switched so fast so I get out my colt and shot him to disable him not to shot ghiless because he was too close to him 1shot = rip ghliess then I go cuffed him after he used /sur and get him on WBPD and started an investigation and I confiscated the weapons which he picked it up and released him .....

we can edit this in some words "You were told to leave, you failed to comply, you got suspected, we asked you to surrender, you brandished a weapon, we took a shot to ensure everyone's safety"

From my knowledge when I reached at the broken shack with a boat, I was told to pick up the crate and confiscate it to the WBPD. Klaus picked up a crate containing some items, he got suspected and warned several times by the officers. David shot him after that and he surrendered. I went back to the WBPD to confiscate the evidence after that.

I sincerely apologize on the behalf of VCPD command for not responding within 3 weeks per law. The investigation will be taken over by me, the verdict will be issued within 3 weeks.

The facts in this case are vague on both sides, containing mostly "he said and she said" with words of opposition from both sides.

The only actual facts I can see at the moment are that Mr. Klaus was suspected by the officers at a site where there were illegal items. It has been stated that Mr. Klaus brandished a weapon on-scene, to which Senior Officer David responded with a shot.

With no evidence to prove otherwise, it appears the officer has acted in accordance with policy, per the following procedure:

10.3. VCPD Officer is allowed to open fire immediately if his, other officers or citizens lives are in imminent danger.

If a person brandishes a weapon after being asked to leave, and in a high-risk situation, then an Officer has acted in accordance with policy and responded to an imminent threat.

The evidence at this point appears circumstantial, and does not show the incident in question with enough evidence for VCPD Command to be able to determine a breach of policy or the law. As the law states, a person is innocent until proven guilty. We currently do not have enough to prove that Senior Officer David Brand acted outside of policy.

If the reporter, Mr. Klaus, or any other VCPD personnel have any further evidence or statements to submit, I will allow 48 hours for any additional submissions, or this report will be reviewed and concluded based on what has been submitted.

Dear complainant, upon reviewing the evidence we have come to a conclusion.



Review:

As aforementioned, Mr. Klaus was suspected by VCPD officers in the area where illegal items were present. VCPD Officers stated that they saw you brandishing a firearm, in the evidence you also stated that you picked up the chrome shotgun and an MP5.

If a person brandishes a weapon after being asked to leave, and in a high-risk situation, then an Officer has acted in accordance with policy and responded to an imminent threat.

Current evidence appears circumstantial, it does not fully show the incident in order for VCPD Command to determine a breach of policy.

The law states presumption of innocence, I stand by that principle when handling police complaints for the sake of not issuing wrongful disciplinary action.

Officers advised you multiple times to leave the area, as shown in the evidence. We currently do not have enough to prove that VCPD Senior Officer David Brand broke regulations and acted outside of policy.

Final Verdict:

As the current evidence is circumstantial, we are unable to determine a breach of policy. As for the conclusion, Officer in question did not break any regulations. As no additional evidence or statement was provided in this 48 hours, the report will be closed with the final verdict in effect.

Officers cleared of any misconduct. No disciplinary action will be taken.

If you are unsatisfied with this verdict, you are free to escalate this to the Vice City Court of Law.
