ARPD Officer Policy violators: Martin Beck and Danny.Bowers

1. Officer Name

• Martin Beck
• Danny Bowers

Short description of the violation.

Martin Beck, applicant of the SAPD and Danny Bowers, SAPD Cadet didn't read out any miranda rights and 'abused' /jail straight after entering the department. I was taken in custody, nearby San Fierro Bayside. They took me with a Sandking to the nearest PD, located in Bone County. There he asked me to enter and as soon as I was in, he jailed me for 100 seconds. Without mentioning my rights (most important; an investigation) or the reason of taking 100 seconds jail.

The sad things is; he was with SAPD Cadet Danny.Bowers who should have teached him how to work as a professional SAPD member. They didn't say anything from the moment I /gu'ed till the moment I got jailed. All he (Danny) said was 'YALLA', Sauron knows why.

You can see at the time of the chatlog that there was no investigation nor a disclosure of my rights as suspect.

Since Danny.Bowers is an SAPD Cadet and because it's going about the same case I thought it would be better to report them both in one(1) report.

I will handle it on behalf of Academy Command Staff, regarding Danny Bower's involvement and co-operate with Lt. Marco Cipone to solve the case.

First things I want to ask.

1) What was your crime and secondary crimes aswell (e.g shooting after being wanted for evading)?
2) Did you evade any police Officers?
3) Did they read you the miranda rights when they arrested you?

I would also like Cadet Danny Bowers to post his statement here as soon as possible.

2. I was driving a car, started to swim and when they came I stopped. I stopped and they still shot me with a combat though.
3. No, they didn't say anything, only: "YALLAH!" and "Follow me inside". I entered and was frozen, so I couldn't even walk to a desk.

Here is my statement. And I plead guilty on the point of not reading out the Miranda rights though I completly forgot it as me and Danny was in a hurry. The rest I have no idea what you are talking about.

- You were suspected for aiding and continued evading when we approached you and we were chasing you.(If I remember right this is the case when you jumped off Gant Bridge with your friends? Wich earlier in the pursuit had been shooting at the police in order to evade. In that case we only fired our weapons on you when you were swimming/diving to avoid us and NOT when anyone of you were standing still.. May not be this case though, if not, explain wich one it is)

- And as the swimingpart, FYI due to Rule [1.1] "-Suspect is airborne/waterborne or swimming -- You may open fire after warning (Any weapon can be used in to stop the suspect from evading.)" I have followed proceduers and not done anything wrong on that point using a combat.

- To the part where we are outside the El Quebrados Police Department you have shown a printscreen when Danny says "Yalla" wich is "hurry" on arabic and I say "Follow me sir". That is bcs you for some reason decided to just stand there and not move, so we told you to hurry and follow inside, wich you might understand we wanted? We dont have all the time in the world to just sit around and wait for you when you do other stuff.

- And Yes, I admit I did'nt read out the Miranda rights though I was in a hurry to do something else(wich is irelevant), It was an honest mistake and I'm sorry for that. But as you are saying that we only said two things is a lie. That is only outside the EQPD.

- Last point; Instant jailing you when you entered the EQPD is a lie. You have to get inside atleast a couple of steps to be able to be jailed. And yes I jailed you pretty soon as you were close enough, but not instant when you entered? It does'nt take more then some seconds to run to the jailbars in that PD. And as investigation, you did not ask for none. And as you evaded, your crime were valid without any questions.

(I will also remind you that Argo is Soft-RP not hardcore-RP, and it is not req to roleplay at all times. In this case I was in a hurry and wanted to everything as quick as posible so I could go do my things.)

If i remember this correctly, you (who reported here) and one of your friends where driving a Sultan through San Fierro while Officer Martin and i responded to the scene. We caught up with you at King's San Fierro as you where going towards Calton hights. Me and Martin was on teamspeak and we said to eachother not to fire at you guys since our Sandking is a bit faster. But then you guys started to fire at us and i told Martin to respond the fire immedeatly. He flat-tired your car and our car was close to expload aswell so we let you go and drove up to the PnS to to fix our PD car. When the car was fixed we drove after you guys again towards Gant Bridge. And in the middle of the bridge the Sultan was standing abondened and we looked down and saw you guys swinning West towards "unknown", as we where standing on the bridge three more officers joind in and we drove towards Bayside to get boats. We drove the boats under the Gant Bridge and pretty soon we found you all still swimming. As we arrived we shouted out Warnings but you guys kept on swimming and diving to avoid us. One of you got neutralized and you /gu. The other boat witch should have taken you on it drove away so we /cuffed you insted and took you to the shore again. There we jumped in to the PD car and drove to El Quebrados where Officer Martin was going to bring you in. I sat still in the PD car. You jumped out of the car and where just standing there. After a while i said "Yalla!" in an OOC way to make you avare of us, since you did not show any interest in moving. I know that "Yalla" is'nt the best way to put it, and that Argonath does not Support OOC, but i was stressed out becuse of irrelevant things, and to that i apologize. I usally read /mir when the SU is taken in to the car but i may have forgot it, and to that i apologize aswell. And what happend inside the PD i can't say anything about since it was sitting outside.

- If it was up to me you should have been jailed even longer, since you showed NO signals what so ever to surrender. You had plenty of time to not evade but kept on doing it, and you guys were shooting at us aswell during this time. You only surrenderd when you had no way to go anymore..

- You showed no interest in RP what so ever so we just drove you up to the PD in El Quebrados to jail you.

- I may be guilty for not reading the Miranda rights, and again, i´m sorry for that. I can accept this report if it's for not reading the Miranda rights. But the rest i will not plead guilty for.

- I typed "/l Yalla!" and i did that to get your attention since you did not show any intention to follow officer Martin. It was more of a none RP way to get you moving but it's not the right thing to say, and i know that. But again, i was stressed out, and that's not your fault, and i'm sorry for that aswell.

- You are saying "the sad things is: He was with Cadet Danny Bowers" etc. What's sad about it? You have no idea if we are speaking to eachother are you? There is nothing that says we need to show you that we are speaking to eachother.

- And about Officer Martin. I trust him truly as an Officer, he's a great partner and he know the rules very good. So if you'r asking me there is nothing I have to teach him.

I'm not like; "/gu > I WANT INVESTIGATION I WANT INVESTIGATION! I'M ABUSED". I expected some professional men who were going to ask if I wanted an investigation, but too bad, you were, as you say; "in hurry" and just simply jailed me. If you're on-duty, do it as you should do it and don't just jail suspects to gain money? Especially not as SAPD. An excuse as 'hurry' is a bit nonsense in my eyes.

Maybe you both don't know , but as suspect, you cannot move if you're uncuffed. This is also the reason why I didn't move in the SAPD nor just outside of it, I was waiting for you to cuff me and read out my miranda rights so I could say I wanted an investigation or phone call of what ever.

"Yallah" is, as you say; Arabic. Isn't this an international server? And isn't the SAPD a group of professionalism? You didn't say anything beyond "YALLAH" and "Follow me inside".

And, in some PD's, you're able to /jail straight after entering. Just like the backdoor at the LSPD.

Why do you have to repeat urself? Both of us have already pleaded guilty, and apologized. Why are you then repeating it again? All the things you are saying in the latest post i have already been explaining for both you and everyone else in here. You are saying that "hurry" is a bit nonsense in your eyes... Really? You had/have no idea about why i was in a hurry. I told you it was becuse of irrelevant things, witch means IRL, and that is no excuse. But insted of just /q with you out in the water leaving you there stranded /gu we took you in.. AGAIN, it's no excuse, but if you say that it's "nonsense" that i was in a hurry, i could not care less. I'm 22 years old and living a hectic life outside the game aswell. . And to call me moneyhungry. Do you really think i applied to SAPD becuse of the money? I got money enough for beeing greedy about it.. I tried to ask you for forgiveness but insted you'r keep on going at us like we are two scumbags.. If i was you i would have spoken to the police officer IN game, since this is just about the Miranda rights. and you could have talked to us ingame about it. Who knows, me and Martin could be really good people, and easy to talk to. But i guess it's a very big deal for you and i accept that. I apologize once more.

- Dont get me wrong, but do you really think that we have the time to ask you everything you MIGHT want? Should we have asked wich Police Department you wanted to go to aswell? If you wanted an investigation, you could simply have asken for one. And the moneypart, I got enough to not need those 600$ you get for jailing somebody. I jailed you quick simply cuz I was in a hurry. And this one I dont understand.. That we were in a hurry is nonsense to you? How could you know what we were going to do? What we were in a hurry to? If we were in a hurry? What it was is irrelevant, but I can tell you that both me and Danny had to do something IRL wich we were in a hurry to. Instead of just quiting the game with you out in the water, we drove you to a PD and jailed you. I really dont see your point and what you think is a problem about that we jailed you fast?

- I did cuff you directly when we got to the PD, you were standing still outside the car, not sitting inside it, and you were cuffed. And inside I cuffed you. The cuffs are applied on your wrists so you are fully able to speak and tell me that you want an investigation, wether you are cuffed or not.

- I take for granted that you know what "Follow me inside" means, wich I said bcs you were standing still, outside the pd, cuffed.

Everything I said here can be found in either my statement or Dannys, or in boths. I wrote it down again if you did not understand some parts of the statements. And arguing here is nonsense, I will leave this up to Lt. Marco and Dolfa to decide and take their stands in the case.

I repeated myself because I thought you didn't really understand me, and I'm so kind to repeat myself.

If you were in hurry, then why did you even chase me and took the time to take a boat at Bayside and took me in custody? Why didn't you call some back-up or let the other officers, in the other boat taking me in. In my eyes it's just for the money or achievements.

And as you can see, you cuffed me I entered on 21:55:45, you cuffed me two minutes later on 21:56:04 and jailed me one second later on 21:56:05.
So you're the one who didn't do anything those two minutes, not me.

Reading out the miranda rights is one of the most important things within the procedures, therefore it is so important to report this.

- On this picture, the first time we told you to hurry was 21:55:30, then you already had been standing outside for a while.

- On this picture, you entered the building 21:55:45 and was inside at 21:55:49 (You then got visualble and it said you hav'nt been thawed due to surrendered.). 21:56:04 I cuffed you, wich is 15 seconds later, not 2 minutes.(FYI I hav'nt said anything about you not doing anything inside the PD, I said that you were standing still outside, not inside.)

- On this picture, you can see that you got jailed 21:56:07. 3 Seconds after you were cuffed. On that time you had moved closer to the cells, not standing outside them, but closer then spawnpoint inside the PD.

There is no need to lie about any time since you have posted screenshots with timestamps. This post was just to correct the wrong times you wrote. And this will be my last post until Lt. Marco and Dolfa has made up their mind about what to do about this case.

Why would I lie, it clearly says what I just posted. I did NOT move in those three seconds.
You should review my screens, because your post is not right.

I entered at '45, not '49. And you jailed me at '05 or something but since the chat lags it says '07.

The point is that you didn't read out my rights, easier said; you failed to follow the procedures.

Summary: The officer indeed forgot to inform you about your rights for which he is verbally warned, but lets not forget here that these officers are still new, they have a long way to go and long way to improve, don't be too harash on them by reporting them immediatly and try talking with them next time.

Punishment: Verbal warning issued to both officers
