Title: [NON-RP] Report on Senior Officer Warren

Directed to: SAPD authority.
SAPD Officer Policy violators: Senior Officer Warren

1. Warren - Disregarding the Constitution when performing police duty. Specific parts of the Constitution ignored: Section II, Ordinance IX.I.II (Temporary access denial: Law enforcement agencies and government officials can deny access to some areas or an entire building for national security reason or any valid reason for a limited amount of time. The denial must be justified but can apply to any propriety or area of the United State of Argonath.), Section III, Act IV (A person is innocent until proven and declared guilty.). Also, very rude behaviour during the investigation. He seemed very angry at some points, unable to keep his head cool.

Suspected for not complying, when I didn't comply with him ordering me to leave an area without justifying it (Section II, Ordinance IX.I.II), forced me into the jail after not being able to prove I'm guilty during an investigation (Section III, Act IV).

Yes, I admit I did start to get mad towards the end of the investigation for a few reasons, it was late and I was tired, I just wanted it over so I could go to sleep and I'm also full of cold which is really annoying me. I suppose this is no excuse for my behavior and I apologize.

What do you mean by semi-seriousness, Sushi? I was, and still am, fully serious about this. I'm a big supporter of our Constitution, and I'm never happy to see it being ignored.

Figured since the investigation does not for certain include the proof of him not providing a just cause for leaving an area (Though my lawyer asked him several times if he did, to which he did not have an answer), here's the log of that.

My statement:

I was driving past East Los Santos when I noticed this man down the alleyway known for ordering heroin. I stopped to investigate and asked him to walk towards me away from the spot, which he refused to do. I suspected him and asked him to surrender multiple times, he did not. 2 other ARPD officer's where on scene at the time. He attempted to run away from me though I managed to spray him so he did not escape. Then I found the heroin and confiscated it. He was then taken to LSPD for a long investigation. He denied ordering heroin, after some time I was starting to get impatient (I was tired irl) so I cleared the charge of ordering heroin, but then due to the fact he did attempt to evade he was jailed.

I didn't comply on two occasions, where I refused to move, as it was my right to know what for, and other when I didn't get my hands in the air right away, as I already explained in the investigation, I was cleaning pepper spray that coming in on me nearly right away from my eyes (His intention seemed to be to move me off heroin spot as soon as he could. Which I could argue is a pepper spray abuse, as he FORCES me to move, when I do not wish to, through the use of pepper spray. You know, forced roleplay and all that. At no point between him arriving and using pepper spray on me did I show any weapons, so I wasn't being threatening either.). As I do not have combat logs, if you do not believe me, we can ask for that from the management.


The only evidence I still have left is chatlog of what happened between the suspection and entering the PD, though it's all irrelevant considering that the reason we're here is because of him not following the state's constitution - not providing a just reason to leave an area when blocking it off; finding people guilty without having proven that.

Sometimes frustration may occur from both criminal and cop perspectives if something doesn't go as well as it suppose to be.

I understand that, from a police officer's perspective, there was a clear reason to jail me, but just like in real life, sometimes the system can be used to get away with stuff.

I just expected Officer Warren to follow the system on his end, it's bad enough when criminals don't (That's why they're criminals, I suppose).

I would like you to get one thing fixed before we move on, basically you are trying to set double charges on officers, meaning - you sued him in court and have set pretty high demands on him, and now you report him on the forums here. If he is found guilty in court already, why to report him here ?

As there's no verdict on the court case, there's no saying if he's found guilty or not.

Regardless, I'll explain:

The court case is just that, taking the law to him, this report is also just that, reporting the person to his employers. Court case is for the purpose of the situation being dealt by the law, the report is for the purpose of the situation being dealt by his "boss", if you will. I don't think they should be mutually exclusive, if you mess something up, there should be consequences from both, the authorities and the employers of the said person.

The demands may be rather high, but there's no saying what the court will decide.

I still would like to keep both report and court case, because, as I said, one is consequence through the law/court, other one is from his command. Should not be mutually exclusive, and I did inquire if there is any ruling stating they have to be prior to making both.

STATEMENT IN REGARDS TO THE CLOSURE OF THIS REPORT

On 11th of October, 2012, at 1218 HOURS a report was submitted by James Hardy as a lawful citizen of the United States of Argonath.
Since then, an investigation has been conducted by the SAPD command staff members:
- Sergeant Def Perry
- Captain Tom 'Walcroft' Adams
- Deputy Chief Kelvin 'Sushi' Gould
- Chief Paul Hernandez

The summary and conclusion of the report has now been decided and will be released to the public.

-- As previously stated by Chief Hernandez, tensions did seem to run high between both parties during the investigation. From what I have observed, there was hostility from both sides, from the officers; being attributed to his ailment at the time and the suspects personality (roleplay character). Observing the logs provided, the officer had valid reason to order the suspect to leave the area but failed to provide the suspect with a reason to do so. During the investigation itself, both parties providing valid statements, the officer decided to jail the suspect without the required proof (Which could of been provided RPly). On the scene, as observed the suspect at first failed to surrender for an invalid suspection, although the suspect clearly knew the protocol for this yet still did not immediately surrender (Roleplay aside, we all know what the immediate thing to do when abused).

-- In conclusion, senior officer Warren of LVPD is being given a warning and is to issue a formal apology to the suspect (Which is to be forwarded to myself via forum PM). As well as this, SO Warren is advised to simply clock off next time he is feeling unwell and to roleplay with the suspect if they attempt to use the system to 'get away with stuff' (Roleplay back when they roleplay aggressively). This is to be considered a serious warning and any further breach of SAPD RPP or constitution of Argonath will result in a much more serious punishment depending on the violation.
