Description of Events:

This morning I was heading to the store for my day off of work in the SAPD, I was proceeding along in my motor vehicle when I had lost slight control of my vehicle trying to avoid something, I recorrected and headed along my business untill I peeped into my rear view mirror and noticed a Crown Vic tailing me for quite a while, so after 2 blocks of up close tailgating, I was blue lighted. I Pulled over safely to the curb in Ganton where I was then greeted by officers Mang_Olas & Shawn_Motisi. We Went through Regular procedures, documents etc etc. At a time during the stop, officer Motisi asked me if I was drunk, I replied no and waited for the stop to end so that I can head about my business, 1 minute later both officers walked to my window and told me to step out the vehicle for a Sobriety Test, I replied to them saying " I do NOT consent to a search" they said its not a search, I then said "I do NOT Consent to any Seizure's" they said they arent taking anything. From that point on, I Requested a supervisor on scene, and they ignored me and mumbled to each other, seconds later the officer demanded that i step out and I Demanded a supervisor on scene stating that I Will not move untill one arrives, in a split second one of the officers drew his Glock and aimed it at me, and I was suspected for "Failure to Comply" even after i continously asked for a supervisor. I Was dragged out of my car in a heart beat slammed to the floor and had guns puinted to my face while I Stood there dazed. I Was read my rights while in transit to the police station.

          We arrived at the police station and I was escorted into the Investigation room, the officers then tried to load me questions, but I Was NOT Read my rights prior to the start of the investigation, and i simply replied "I Demand a Supervisor". Moments later senior officer Darkshadowblade entered the room, and he collected my side and the officers side, he saw some errors in the officers side and asked if they atleast read me my rights before this investigation, they said no, and from there i was Released from custody. Officer Motisi snapped and shouted at the Senior saying "You sir, are a waste of time, sargent" Officer DSB Returned and asked for a repeat, but the officers quickly left the station, I Stopped by DSB and he told me that I Was lucky, and I Chuckled and left to head to my vehicle.

       I Found an armored truck outside, and used it to transport me to my vehicle parked in Idlewood after the charges were dropped, and i was a free man, upon crossing the railroad tracks, I Noticed a Crown Vic parked again behind my abondoned vehicle, and from there I Saw with my eyes the 2 officers standing with Guns drawn, Discharging rounds upon my vehicle, i guess in rage, as I Approached in the armored vehicle, Officer Mang_Olas saw me approaching and jumped back into the PD Crown Vic while Motisi just realised what was happening and stopped to run back in the car. I Stopped behind them and pisitioned the truck to cut and block them from fleeing, Mang screamed on the Megaphone to move along, but I Was there for a reason they were hoping I Didnt see. Mang then threw the PD Crown Vic in reverse and fleed the scene after i screamed stop. I Then pursued them in the Armored truck i was using all around the city untill I Lost them on a straight long road.
I Then realized that they were gone and PMed Senior Officer Ben_Rosso immediatly asking for him to have "U16A22" Return to the Station immediatly, once I Arrived at the station in the armored vehicle, Officer Motisi saw what was happening and /q ed immediatly, Mang, Ben and I Were in the room but he fased off everything I Said Denying that he did anything or that he was even in the area at the time and from there I Left.

I just want to point out first that the Non-RP format is wrong, it's supposed to contain the names of the officers you are reporting not who reported it.

Ok, let's start off first with that I was in the middle of a ride along when all this happened, and I probably can't remember every single detail since I was trying to have the Probationary Officer I was giving a ride along to what to say to the suspect who was asking for an investigation because I was called into the next room. I will first begin with how their is misuse of power here (that is actually an RP report but the way they carried it out was more of a bad attitude then anything else). The 2 Officers informed me that they saw the civilian, DamienT swerving on the road a bit. He was pulled over and the officers tell me that he refused to comply with a breathalyzer examination, I asked why and they said "We think he was drinking and driving," however, they didn't search his vehicle. If they don't search the vehicle (which they have probable cause too) and find any alcoholic beverages then they have no reason to force someone to be breathalyzed (and I would consider it Force RP if you don't even search the car).. Even though DamienT did NOT consent to a search, they still have probable cause to do so, but they didn't.

On to the next part, It is Standard Police Procedure to read someones Miranda rights AFTER cuffing them and BEFORE an Investigation. This was not done so I had to drop all charges. Now this is not what I'm concerned about, I am more concerned at the fact of the disrespect to Superiors I found by Shawn_Motosi telling me that I am "a waste of time." This charge should also be added onto the report. Now on to the part where DamienT said the cops were shooting at his car. The RP is over... you don't go back to some civilian's car and shoot it up, and while DamienT was a bit out of line for following the officers instead of calling a superior (I believe I was AFK at the time and he did call a superior by PM but calling 911 may have been better, because I was finishing the Ride Along Report) the behavior exhibited by the officers is way out of line. Unprofessionalism while Onduty, Misuse of Power, Disrespecting Superiors, Private Property Damage, unlawful detention (refusing to comply is fine, but the citizen has a right to not consent to a search, you have to have probable cause to issue a breathalyzer exam. To gain probable cause you should search the vehicle (you have probable cause to do that for his driving) and if open alcohol bottles are found then you have probable cause to issue a breathalyzer exam), breach of citizen's rights... And forgetting to mirandize a suspect before an Investigation leads to all charges against them being dropped. I don't have any screenshots to provide or chatlogs... I believe DamienT should have those and provide them. I also want to point out that Shawn_Motosi's remarks to me is disrespecting superiors and therefore that extra charge should be filed against him.

I must agree that the situation should be treated as a RP report however you returned to DamienT's property and started shooting at it, I would not count that RP and more of having a bad attitude with him but It's seen as misuse of power and private property damage; this includes shitting on a fellow officer (one who is also a superior) by saying "you're a waste of time sergeant." (By the way, I am not even a sergeant? you called for a supervisor and I was right in the next room...) Now, since the 1st portion is something you should consider an RP report, you will need RP evidence. The 2nd portion like I said; I personally would consider it as Non-RP but It might as well be considered RP even if you didn't see any RP due to the fact that most of the misuse of power happened in the 1st part and not so much in the second, although why did you return to the scene anyways? To sum up what I need to say, is that I believe this report should be a RP Report, although having a bad attitude with a fellow officer and superior is something I would not count as RP but this is something for Staff Sgt. Nexus Riggs to decide. So DamienT, I would advise you obtain RP evidence, meaning you need to describe how you got those pictures?

Sr. Officer DSB, I did not participate in insulting you, and was against it actually. About the car, we did roleplay that situation atleast between us 2, our characters got annoyed, because investigation was unsuccessful and did what they did.

When did I say you insulted me? Go back to my first post... It was directed to Officer Shawn_Motosi not to you, Officer Mang. Honestly this situation is messed up from where I see it. It really should be an RP report, as the misuse of power was seen. There wasn't enough reasonable doubt to say DamienT was drunk to where he needed a breathlyzer exam. He may have dropped something in his car and moved to go get it, causing his car to swerve a bit. Unless you were to RP search his car (you do have the reasonable doubt) and find alcholic containers which are open, then you would be able to issue a breathlyzer exam. But to be honest and fair here, the only thing bad here was the remark made to me, and I really wouldn't go and make a report out of it. DamienT was not prosecuted so I don't understand the first portion of his situation because all charges were dropped. There was a slight misuse of power there, but the main issue here is that you two officer partook in shooting at DamienT's private property and then when he asked you to stop you kept moving along, like you were fleeing the scene? Evading? Doesn't that legitimize crimes for suspects? Why not for the Officers who shot at his car? Really I would personally not see why anybody would get suspended for the actions that took place here but rather warnings on not to do it again... But I'm not Staff Sgt. Nexus Riggs, it's up to him on what to do, but I'm trying to insert my view here and what I think would be happening here so my comments remain as unbiased as possible.

Just to clear things up,
I Supervisory Officer Ben Rosso received a PM from Damien that Officer Motisi and Probationary Officer Olas were unprofessional.
I've asked Officer Shawn Motisi , Probationary Officer Mang Olas and Senior Officer Darkshadowblade to head to the station (LSPD).
Officer Olas came to the station, Officer Motisi left the server and Dark was at LSPD but he was AFK.
Damien (who was not on cop duty) had a talk with Probationary Officer Olas, I saw Olas denying what Damien said.
I had to go so I've asked Senior Officer Pedro Cipone to report to the station.
Damien told us that he'll take it to the forums.
I told Senior Officer Cipone that I didn't need his assistance anymore and I went offline.

We did not pull over him two times that day, at least not as far as I can remember.
He was asked to step out of the vehicle and perform a sobriety test because he was he was constantly changing lanes, driving in zigzags, just driving suspiciously. We suspected that he may have been drunk.

STATEMENT IN REGARDS TO THE CLOSURE OF THIS REPORT

On the May the 4th  2014, at 01:10 HOURS a report was submitted by Damien Taylor as a lawful citizen of the United States of Argonath.
Since then, an investigation has been conducted by the SAPD command staff member:
- SAPD Staff Sergeant Nexus Riggs

The summary and conclusion of the report has now been decided and will be released to the public.

-- After analyzing the report, statements and evidence from all parties, I have reached a conclusion. During the traffic stop, Mr. Taylor lawfully insisted that he did not consent to a search but Officer Mang Olas withdrew his firearm and aimed at Mr. Taylor without a reasonable cause. At the police department, Officer Mortsi disrespected the senior officer in contempt manner who was called upon to assist in the investigation.   

-- Allegations of Mr. Taylor being shot at has no conclusive evidence to prove the claims, therefore those allegations are dismissed.

-- In conclusion, Officer Mang Olas will be issued 2 day suspension from police duty.
-- Also Officer Shawn Mortsi will be issued 1 day suspension from police duty.

If the verdict of this report seems unfair to anyone, you can report this to a Captain via the ARPD Forum PM and we might reopen the case if your argument is valid enough.
