Why would he be arrested then?

Because Canada has an anti-terrorism law that forbids the taking of pictures of government operations or property. Including airports, government buildings, police / rescue operations etc :P

In the State of California, you may take photographs and video of anything in public, whether with permission or not, unless the scene is declared either a crime scene, or a disaster zone. Only members of the media may enter disaster zones. No one except law enforcement and authorized persons may enter a crime scene.

So if an Officer goes out on a traffic stop, and you take a picture of them and then stick it on facebook, you cannot get in trouble from that. However, I'm speaking legally. You may be subject to a lawsuit though
