SAPD Officer Policy violators: Officer Dario.Cipone

1. Dario.Cipone - Police misconduct during a traffic stop.
2. Officer's Department - I am guessing SFPD.

I believe evidence isn't quite needed at this time as the officer should give a reply on what happened. The officer tried enforcing a traffic ticket for speeding, despite the fact he had no valid evidence.

Date: Today - March 7, 2013
Time: Around 14:45 PM (server time)

Civillian(s) involved: None

A court case was processed, but I was told I would need to report the officer to his superiors. The case can be seen here. A lot more information is shown there.

Here's what happened:

I, Antonio Gvardia, was pulled over by Dario Cipone and his colleagues today at around 14:45 PM in the North Esplanade area of San Fierro. I had just parked my car at Pier 69 and before I was able to even open my door, I saw two police cruisers behind me with their sirens turned on. The officers ordered me to turn off the engine of my car, which I complied to. I was being charged for speeding by Mr. Cipone, claiming that I was going too fast in the Doherty area. I asked for evidence that proved I was speeding, because I don't remember seeing any police cruiser during the time I was driving, nor any police cruiser attempting to pull me over. I was pulled over in the Esplande North area which is not very close to Doherty, and this was when I was just about to exit my car.

The evidence that I've received from Dario Cipone showed only the speed of my car, but not where it was recorded or when. I entered San Fierro through the high-way, so if the speed was recorded there it would be invalid. I then informed Dario Cipone that I believed that the evidence was invalid, but Mr. Cipone was trying to give me a ticket of the price of $250. Mr. Cipone insisted that all the evidence available proves that I had done the stated offence. I offered Mr. Cipone the proposal that he should open a case against me in the Criminal Court, but he refused and decided to jail me for "refusing to pay a traffic ticket".

I was taken to the San Fierro Police Department, and there I was jailed by one of Mr. Cipone's colleagues, [Gstar]Josh. Mr. Josh was handling the traffic stop under the defendant's orders. In the police department, another officer, known as Anthrax Rosso, ordered Josh to send me a jail for the maximum time. I place Mr. Cipone responsible for the foul play since Josh was under his orders, and Dario Cipone played the main role of the incident.

I'll explain by my part, what happened.
I was patrolling around Doherty with ARPD Officer Bangoh and ARPD Officer [Gstar]Josh.
We decided to make a speed trap at Doherty, between the Fire Department and the Gas Station.

I was the driver, so I've told to officer Bangoh, to use the speed radar (actual command /speed), as he was on the passenger seat.
After one minute, he passed in front of us and the /speed recorded 119km/h.

He went so fast enough that was not possible to stop him in the route, by the way he decided to stop the car at Esplanade North. We arrived there in one minute.

There isn't really any regulation about having evidence to issue a ticket. Some people do it for the sake of roleplay, and some don't.
So what exactly are you reporting him for?

Excuse me, but you can't issue a ticket for the hell of it, that's actually forcing role-play. As already stated, the report is for police misconduct.

And this was role-play, I defended myself based on what Dario claimed.

You're claiming I was coming from the opposite direction you were parked, yet you couldn't catch up to me because "I was so fast"? The police cruiser is faster than a Sultan, and there's no chance that I could have made it all the way to North Esplanade with you not having any visual nor me seeing any sirens or warnings to pull over, especially based on the description of where you supposedly caught me speeding.

I said you refused to take the incident to court, since you had no proof and that I was not obligated to pay that ticket. It would have been the best solution for the judge to handle it, but you decided to take me to jail and let your colleagues jail me for the maximum amount of time.

Second, you used to refuse any investigation.
That's because I thought I could be able to fix the solution in the court house. I was informed by a judge that I had to report the officer to his superiors before opening a case. The case was opened, but maybe if the officer states he's willing to continue with the case, the judge will allow it.


I also thought only RP evidence is allowed? Dario has just copied chat logs and other things he hasn't explained how he got to be valid as evidence.

Yes but there is no regulation about it. Never has been any regulation about having evidence to issue a ticket.

So, if you believe that the traffic stop was incorrectly conducted - then by all means, the report will proceed.

There isn't any regulation on it, but we do have this in the constitution:

Can you elucidate to me on this? Did the officers ever show you this footage? And what road were you driving on when you happened to 'speed' at the rate of around 120 KM/h?

Officer, a speed radar was shown with a speed of 119 km/h. The problem is, I don't know, which is why I asked the officer for evidence of where I was caught speeding, the officer failed to do that. On that day I remember also being on a highway, which would make it invalid. I could have been outside the city which would still make the ticket invalid. The only time I noticed police were after me was when I was parking my car in Esplanade North. Until then, no cops were engaging me...

When I requested evidence of showing where I was and my speed, I wasn't given it. Instead, the officer decided to use "the witness" argument against me, which I find completely unfair, since they were his colleagues. Even though one of the officers came in a separate PD cruiser, he claimed he was a witness. I don't remember Dario Cipone mentioning another cruiser patrolling with him.

Only problem I see in this whole thing is lack of communication from all sides. Including evidence and such.

Officer, due to the fact that Dario Cipone wasn't able to present any valid evidence, I gave him the advice for him to proceed with it in court, specifically Criminal Court where he could have made his claims. Instead, the officer decided to put me under arrest, which is illegal and against the rights stated in the constitution. Once I was put under arrest, I complied with them, yet I was placed in jail for a maximum amount of time.

The officer has clearly abused his power.
