Report against:
[NP]Monte.Montague - Inappropriate behavior as an officer, invalid reason for ticket issued

Description of events:
I was near Pershing Square and I had parked my kart near City Hall to meet with my friends. Suddenly, an officer named [NP]Monte.Montague had approached us and asked who the vehicle belonged to. I had claimed that it was mine. He then said that it was parked illegal and issued me a $250 citation. I was unsure of how it was parked illegally so I continued to ask how it was illegally parked. He then suspected me for "failure to pay a ticket". I instantly gave up and requested an investigation. However, the officer just dragged me around and into his cruiser. I was put in the back seat and was driven to LSPD. He kept dragging me and we arrived into LSPD. I asked if I could have a investigation but he just kept dragging me. I however stood in my spot occasionally. I demanded an investigation constantly. We then ended up near the jail cells where another officer had appeared. They then kept insisting I go into the jail cells but I just kept replying with a want for an investigation. Both officers then had striked me with their batons. I was nearly dead but I stood strong. Then, some higher ups had appeared (admins) and told Officer [NP]Monte.Montague to give me an investigation. He finally escorted me to the room by the cells. I asked him what he had given me the ticket for. He replied, "parking in front of city hall which is not allowed". I was sure that was not a traffic offense.

*I then had to leave the server so I had walked to the jail and let him jail me*

This photo can describe how they were unwilling to give an investigation as well as a punch from a different officer.

No rp was conducted in terms of recording.

Requesting private audience with yourself (>inb4 breaking chain of command) as some comments of my intended post are best suited for someone who's in administration.

There was no actual need for an investigation, however one was given.

What I said in the investigation was told to him prior to the investigation.
There was no other officers on-line to give him an investigation (other than the one who was attacking him).

I am innocent.
Suspect was simply time wasting and was refusing to let me do my job.
I do not see what regulation I have breached.

If anything this is an issue of which the civilian tried to force his roleplay onto me and this case does not belong here.


Ticket was lawful, and his supection was lawful. Use of force was justified as suspect was belligerent and failed to comply, even after being sprayed. No lethal force used, no force used from my end which would seriously harm him.

I am innocent of any and all accusations.

No regulations breached, no misconduct from officers.
Nothing.
No Roleplayed evidence.
Nothing.

Just a person who was mad he was caught out on a law he did not know.


"Inappropriate behaviour as an officer" - nothing to show or prove that I did act inappropriately.


This case is flawed and illegitimate - an illegal case, and I feel it can be seen as obstructing the course of justice in itself.

The suspect agreed that the information was true and therefore valid, but it was not, and so this case is illegal entirely.

No evidence exists.
This case. Illegitimate. He can re-create it when he has that evidence.

Witness does not seem to be notified of this case and witness is unfit as at the same time I was being told to ignore him by an admin as he was an attention seeker according to the admin.

Also it's still a roleplay server so it'd of been good if the suspect showed roleplay in the contacting of the accused, and also contacting of the witness (altho what I said above applys)

    STATEMENT IN REGARDS TO THE CLOSURE OF THIS REPORT

    On the March the 7th 2015, at 02:50 HOURS a report was submitted by DinoKid23 as a lawful citizen of the United States of Argonath.

    The summary and conclusion of the report has now been decided and will be released to the public.

    -- According Ordinance XII of the constitution;
    Quote
    Ordinance XII:  In the case of arrest or detention, a citizen must be promptly informed of the reasons, must also be informed that he has the right to a lawyer and must be allowed to use that right as soon as possible. He shall also have the validity of the detention controlled by the present law and to be released if the detention is not lawful.
    Despite the request of the citizen to investigate the case further. The law enforcers initially denied the request. Therefore they indirectly denied him the right to contact a legal representative. Therefore the officer can be found guilty, based on the ordinance.

    -- According Act XVI of the criminal law;
    Quote
    Act XVI: A law enforcer cannot be blamed if injuries or death occur if a suspect opposes resistance.
    Usage of force against a suspect is permitted. However, due to the denial of the right described in Ordinance XII. It does not apply in this case. Since according Act IV of the criminal law; "A person is innocent until proven and declared guilty.". Therefore it is not possible to force the suspect to jail. The action of the officers might be considered as Mens rea.

    -- In conclusion, officer [NP]Monte.Montague misconducted meanwhile he was on-duty. However, the evidence that have been provided is not considered as roleplay evidence. Therefore the accused won't be punished.

    If the verdict of this report seems unfair to anyone, you can report this to a Deputy Chief via the ARPD Forum PM and we might reopen the case if your argument is valid enough.
