[AD Report] SAPD Officer [WS]Kangaroo
« on: June 23, 2013, 18:04:28 pm »
    Directed to: SAPD authority.
    ARPD Officer Policy violators:

    1. Officer [WS]Kangaroo - Abuse of rights to obstruct my civilian rights.

     a. Pictures -

     b. Description - On the noon of 22nd June, 2013, I was forced to go to the jail for standing at a public property (pier) close the the restricted area of Santa Marina Beach for a wedding, however, NOT on the restricted property. That area I was at in no way restricted as it had no barriers or police officers covering it what so ever. My friend Harris and I were admiring the decorations and fireworks and took some pictures to share it with our friends. We were confronted by two officers who were fine with us being there and they let us be there.

I dropped Harris at his place as he had to go and returned to the location. I was later confronted by officer [WS]Kangaroo who repeatedly asked me to leave but I didn't do so as it was a public property (even at the time of the event) and was not restricted by anything. I reserved my right and defended myself by saying that I had the right to remain there. The officer then suspected me and I was taken to the police station where I was investigated and let go in a condition that I won't return to the place. During the investigation,
    • I was accused of possession of sniper and aiming it at the individuals inside the event while I never had a Sniper at that particular moment.
    • I was accused of suspicious activity while it was cleared out by the officers who first appeared when I was with my friend Harris.
    • Last but not the least - I was not allowed to stand at a public place which was still not restricted at the time of the event.
I was also being forced to go to the jail to which I resisted as I had not been given a proper investigation even though I had immediately given up to the officers after being suspected.

    [/list]

    Constitution says:
    Quote
    Ordinance IX:
IX.I.II: Temporary access denial: Law enforcement agencies and government officials can deny access to some areas or an entire building for national security reason or any valid reason for a limited amount of time. The denial must be justified but can apply to any propriety or area of the United State of Argonath.
The restricted area was obviously and visually the beach and not the pier which I was standing on. It was never announced that the pier was as well restricted. Neither was I told that when I was suspected. I was simply told to leave to which I defended myself.

    Date: Saturday, 22nd June, 2013
    Time: Around 13:30 CET

    Civillian(s) involved: Harris Corleone

I was on Air Division duty at the time. I had asked you to leave mutliple times and I had officers telling me you were aiming a weapon. Therefore my suspection. As for the investigation, yes I may of rushed it. But I don't usually perform investigations on my own suspects. That's why I was trying to obtain another officer.

Good morning dear Air Division Command staff, dear plantiff Charlie_Corleone and dear Officer [WS]Kangaroo,

As you can see in some of the screenshots provided, i was present in the wedding when this has happened.
I was representing a government agency at the time, and my task was to make sure that everything was secure and that there are no possible threats for the participants of the wedding or the president.

Mr. Charlie Corleone has entered an area who was considered restricted at the time, since it was a potential sniping spot and was endangering the public and important public figures that were attending to the wedding. I have spotted him and Mr. Harris Corleone walking around at that spot and i indeed saw you aiming something, due to a long distance i could not figure out if it was a camera or a sniper rifle. Therefor i have informed ARPD and on my behalf they were sent to check you two out. The positions you were stationed in were potentially dangerous, this is the reason why you were asked to be removed from the location. Officer did nothing wrong as he has warned you enough to leave the place before actually suspecting you.

    I'm also attaching some evidence:

Have a nice day and i'm looking forward for the outcome of this report.

I never aimed any weapon at anyone. Show me proofs.

As a witness, I can confirm this.
Confirming won't do it. Show me proofs.
Don't say that you're a cop and what a cop says is true. I want proper proofs of me aiming a weapon at any officer.

First off, I never aimed any weapon at anyone. I'm not some random person in the server with no common sense. I knew how high profile was the event and what could lead to if I shot or aimed at anyone. On the other hand, you can not tell a person to leave a public area. The restricted area was the BEACH and only the BEACH. There wasn't any police barriers, cars or police covering the pier. It was NEVER announced that the pier was closed as well. CBF only said that the BEACH was restricted, not the pier. You can not just randomly come and block me off a public property, which I as a citizen have complete right to. Had it been previously announced by CBF or were there any barriers, police cruisers or police blocking the pier, I would have never gone there.

Any gates or barriers that were used were all kept on the beach, NONE were restricting the pier.

    Your argument is invalid.

The spot was never announced as a restricted spot. As I said earlier...
    Quote
Had it been previously announced by CBF or were there any barriers, police cruisers or police blocking the pier, I would have never gone there.

    Your evidence prove nothing.

Therefore, the officer can not simply warn me as I reserve my rights as a citizen and can go anywhere as long as the place is not restricted. (YET again! The place was never announced restricted by CBF. All CBF announced that the beach was restricted.)

    Your argument is invalid.

There was no barriers restricting the piers. Therefore it was not shut down. And you confirming statements of Pulse, don't what what statements. But I, in no way, was a security threat. I was falsely accused by [WS]Kangaroo for aiming a weapon. I was accused of entering a restricted area which at that time was never announced restricted or seemed restricted as there was NOTHING at all restricting the pier.

Even two officers [WS]Thomas_C and Taseen came and cleared us out. I know they were not part of the security but 1. They cleared us of any security risks, 2. Even though they were not part of the security, they must have had an idea which part is restricted and which part was not. Nobody was ever informed that the pier was shut down. An officer can not just come and make up something without it being announced to the public. CBF was the one announcing everything, he never announced that the pier was closed.

What I fail to see is any logic behind your answers. Everything you did goes against the constitution or was made up.

    Yet again -
Basically I asked you multiple times and I approached you saying to leave.

It was my call that you had a firearm, but there are multiple people that can confirm you did.

    INTERNAL AFFAIRS

    Dear Charlie Corleone,

Flying Officer [WS]Kangaroo had requested you a multiple, to leave the area. You have rejected to comply with his reques.

    According Act XXIV:
Act XXIV: Disobeying the law is a straight jailing unless there is another punishment prescribed by the law.

You have to comply with the law enforcement, if they have a valid reason for it.

According Ordinance IX a law enforcer has to justify himself. The Flying Officer had a valid and legit reason to denied the temporarily access. But you rejected to comply, therefore Act XXIV allows him, to suspect you.

However three eyewitnesses have spotted you aiming, a weapon. Since the president was attending at this event, this could be considered as a high security threat.

Don't try to twist the story. You people first said that I aimed a Sniper, when I proved that I did not have a sniper at all. You guys took advantage of me admitting to have other weapons. Show me proper proofs of me aiming weapon at anyone.

ALL the officers were far away from me, they don't evne have any idea what I was aiming. They just saw me "aiming", weapon or not, they have got no idea as I was literally about few hundred metres away from them.

So you admit you were aiming "something"

That still can be counted as a risk. Regardless if it was actually or not. We took it seriously and did what we thought was correct and that was to remove you from the area. We asked once and then I heard other members over TeamSpeak shouting that you were aiming something, I checked it out, I asked you to leave and you refused, hence a suspection.

By your logic media persons are considered security risks. Now you're twisting the story, I never denied having aimed something. What I denied was aiming any kind of weapon that may be harmful to anyone. A camera in no way is a weapon or harmful to anyone. Stop it.

Yet again, you CAN NOT tell me to move out of a public place, I have the right to move anywhere in Argonath without any obstruction. That place in no way was restricted or shut down.

Because I and another officer in the teamspeak channel, both aimed our sniper to see what weaponry you we're using, and with weapon, I ment sniper.
Now you're saying that you were aiming a sniper at an innocent civilian? Thank you.

P.S. You still haven't proven that I had Sniper in possession.

    INTERNAL AFFAIRS

    Dear involver's,

The ARPD Air Division command has investigated this case and determined that the case will be closed, without further consequences for the reported Flying Officer [WS]Kangaroo.

This decision has been made on the follow facts:
The reporter, Charlie Corleone has admitted that he was aiming at the restricted area. To due the distance the Flying Officer could have misinterpreted the object that the reporter was holding. So he requested you to leave the pier, according Act XXIV you have to comply with this request. But you failed to do, so he was permitted to suspect you.

This action can be justified by the fact, that he wanted to be sure than to be sorry. Since the president was attending.

Although multiple eyewitnesses do claim that they have seen that neither it can be proven that Charlie Corleone was carrying or aiming any firearms nor it can be proven that he wasn't.

    Signed by,
