Report against: Luke
OFFICER'S NAME - Abuse of /sb

Description of events:
We performed a traffic stop on this civilian, who was basically driving extremely recklessly. Once we were trying to talk with him, he took out his badge and showed his badge. From that point, we couldn't really give him a ticket or anything.
This is intorellable as higher ranks are committing crimes and using their power to avoid trouble which is known as corruption.

You should have been directed to me as I was ingame at the time and I am the officers supervisor. Having spoken with the officer he feels he simply identified himself as a law enforcement officer. He didn't demand to be let off of anything he just stated who he was. As a division we are currently testing out lots of new kit with the arrival of our new vehicles. One of which was being driven at the time of the incident. Unfortunately for us currently the /siren script is not enabled hence it's hard to be able to conduct the quick responses and patrols without drawing the attention of other Leo's we try our best to inform others about our presence and that's what I see my officer doing here. Simply informing you

As lieutenant Megamidget has stated, and i also did in game i was carrying out a UC patrol to get myself closer to any criminal activity without my position given away, I at the time of being pulled over as seen was showing no badge, but as I was on duty and stated this earlier in the radio I felt it necessary to state to the officers who I was, before I had any real time to tell the officers the full details of my patrol they stated I was being reported and left the Scene. I feel I did nothing wrong as I simply Identified myself as a SAPD member of staff and slipped my badge back away so the officers could carry on their stop. It was their decision to not carry on and drove off. I admit when they pulled me over the driving style may have seen to be a little fast but as stated by Megamidget I was in a A.S.I.D. Vehicle and was routinely patrolling, I wasn't speeding but i did loose control of the vehicle. Which is where the officers attempted to pull me over where I was very compliant and identified myself.

First of all. There's a difference between saying "Hi, I'm an undercover Officer" and literally shoving your badge in my throat. That's not called identifying yourself as an Officer, that's called abusing your badge to avoid a traffic stop.

The person was not responding to any situation and was driving like a complete maniac.
It took us a while to catch up with him and his speed, but when we reached, we conducted a stop. I was going to question his driving, but then he suddenly shoves his badge into us.

Again, first of all.
I don't care who you are. You were driving like crazy, therefore that is misuse of authority.
When we pulled over a person who is a civilian, we decided to detain him but the first thing he does is shove his badge into us which was completely intended for avoiding the traffic stop because with the driving, I was going to arrest you. Your driving in no way justifies just a ticket.

This person didn't even talk at all, he simply showed up his badge to avoid the stop and the arrest. We left the scene because we couldn't really do anything after that.

Does ASID's routine patrol include driving on pavements, drifting, hitting poles and speeding? If not, I believe that's misuse of authority. 


LASTLY,
Since all of you are including NON roleplay details such as

I don't see why you are going to lock my topic if my evidence is NON Roleplay.

No offence lieutenant, but everyone here knows how close you are to Luke, which makes me doubt your authority here. Just sayin'.

No Sir, you may not. I don't feel comfortable discussing my position in FBI here since that has absolutely no relation to what's going on here. Lets stick to the topic.

Mister Lieutenant, please don't embarrass yourself. Your reply here clearly shows you're more interested in defending the person rather than coming to a conclusion of the report. So lets not put it as "simply making your points", shall we?

Yes, unfortunately since I reinstated my staff group was never given to me. I also couldn't get the rank in game since the RS5 scripts because I just can't catch higher ranks.

As I already stated, I was not abusing my power at all as I was on duty and was on patrol so when you pulled me over i simply showed my badge to remind you of this if you didn't see earlier that i reported 10-8 from LSPD, also with regards to me shoving it down your throat i merely showed it you slipped it away and was about to explain my situation, but before I had any chance to do so you both raged at the fact you were no longer going to get an arrest and turned to reporting me instead. Had you have  taken the time to actually RP and talk to me about the situation you would have found out the real reason behind why I did what I did, I showed it quick so i didn't alert any civilians. As stated previously I admit my driving style was a little poor shall we say, but as any person  that has ever patrolled with me can vouch that is not a one off thing I admit my driving is terrible. I was not speeding and it did not take you long to catch up because as soon as i saw you turn around and come after me I pulled over immediately as I had nothing to hide.

Like I said, if you could've identified yourself as an LEO properly instead of taking out your badge, that wouldn't be a problem. We intended to suspect you for that driving, and thats why we were getting you to step out of the car and put your hands on the roof.
Guess what? You saw it coming, and you decided to pull out your badge in front of us to avoid the whole arrest because obviously it would mean you're going to get in trouble.

If you didn't wanted to be arrested or talk about the situation, you could've requested an investigation and we would've gladly gave you one. However, pulling out your badge like that isn't a solution.

Lets not understate. Lamposts, drifting, driving on pavements what not. Anyhow, I was still going to arrest you for that. I do have the authority since I believe that kinda reckless driving justifies an arrest. I won't be an abusive cop who'll suspect you straight away, but we intended to stop you and perform an arrest properly. Lets not argue whether the arrest was lawful or not, you could've requested an investigation.

However, what happened was, your quickest and most effective way hindered our procedure. You did not talk, or explain your rank. You simply took your badge out and handed it over to us, which to me looks like you're using it to avoid the arrest.

Nobody is saying you were rude or ignorent, mate. However you did misuse the badge to avoid an arrest. If you feel its wrong, just request an investigation.
Again, pulling your badge out like that is not the correct solution to avoid an arrest.

In my eyes it was a simple traffic stop by two officers so all I did was took out my badge as I already stated to show who I was, the badge speaks for it self as I have also already said I then would have gone on to explain who I am but as you both weren't happy that you were not going to get an arrest you left. I had no idea you were going to arrest me as I am also a officer of the law as you can see and no way was anything I did an arrest able offence. I did nothing wrong all i did was identified myself as an on duty police officer. I therefore have nothing else more to add to this report. Sergeant Celso Williams will make his decision.
