Name: Padres Rosso

Report against:
=AV=LukeN - Excessive use of force, failure to read rights aswell as during arrest and during investigation, performing unlawful arrest without clear evidence and only based on clues.

Description of events:
All that mess started when I got into my new rented vehicle as suddenly the car alarm went off while driving. I was then immediately on my way to the nearest mechanic garage to get someone to check up on it. Although that was interrupted by Officer Pedro who pulled me to the side - as suddenly Officer LukeN came, pulling me out of my own vehicle and handcuffing me forcefully. I am therefor accusing this Officer for excessive use of force on a citizen. I was unaware of the grounds on this arrest and was only given the reason for it on station. Officer LukeN has also failed to read my rights appropiately.

During the investigation I requested he kept trying to act like I had different stories and kept trying to make me say something wrong. He also refused to let me hand him the official documents of my rented car. To get this situation more clear - the alarm of my car went on due to a malfunction or something, hence why I went to the nearest mechanic garage. It seems the alarm system has also sent a notification to PD which is the reason why I got pulled over.

After LukeN had finished the investigation I kept yelling at him that I do not agree with it and that he has no lawful evidence to even detain me. Afterwards he literally PULLED me down the stairs and threw me in jail.

Evidence:
I got cuffed up immediately. Police Dashcams of Officer Pedro should clearly show LukeN throwing me out of my car though.

I supervisory Officer Luke plead not guilty to these acusations. There was a report of a stolen yellow phoneix which was reported to have been broken into from LSPD and the alarm of this car was reported to be going off. I therefore came across this very vehicle where I found Padres Rosso driving. I then used the force i felt neeccassy to ensure the indvidual did not run away as after all a suspect who has stolen a vehicle is likely to run. I therefore disabled this possibilty and removed him from the vehicle with force. I then proceeded to cuff the suspect with force to stop him running away. I then took him to LSPD where i explained the whole situation and asked the suspect for his side of the story. His story changed three times from the moment i stopped him to just before the suspect was jailed. His first reason was it was a friends. Then he rented the vehicle and then finally it was his. I then questioned him about him calling it his where he then back tracked and proceeded to state that because he rented it off a friend who worked for the company he rented it off it was his car. I by this point was extrermly satsified that the individual that was there was the individual that stole the vehicle. I then informed him that he will be jailed for possestion of stolen goods/theft of a motor vehicle and jailed the suspect.

I have never stolen a vehicle and never had the intention to. Your report is either made up or I am just randomly close by that area to be SUSPECT. You have yet not provided solid evidence to prove that it was me, who stole that said vehicle. Besides that, you simply approached me and pulled me out of my vehicle without saying a single word. I am also gonna repeat again - I have official papers saying that I rented that yellow Phoenix. Stop it already and admit what you have done.

I asked you on the day of your arrest if you could provide the delivery drivers details and whether  you could prove the vehicle was yours and you did nothing. It is ow two days later, my senses tell me that you have made them yourself. You were jailed for handling stolen goods the vehicle you were in was reported stolen and that the alarm was going off and you were reported. I find you in a reported stolen car with the same alarm going off. That to me is enough evidence, you need comment no more on this report and no doubt my supieror officers will look at and close this report on me.

Listen up. On the day of my investigation you did not let me provide you evidence of me owning the Phoenix and no, I do not know who the delivery driver was and I think he isn't even of importance right now.

Ah right, now you even accuse me of document forgery, what next?! That is an insult and I will not forget this one, believe me!

"same" alarm going off? Sir, my car had a malfunction and I can still provide you official documents of the renting company.

With all due respect sir, i think you are missing the point here. A call came in a yellow phoneix was stolen from LSPD with an alarm going off as the suspect drove away, that very suspect which was described to look like you. Not only that in questioning if you recal correctly you informed me you had not been near LSPD. But funnily enough the car was gone and you were in it.

Oh? Suddenly I was described by someone? That evidence was not provided in my investigation and you have yet not officially shown ANY evidence, I am not even sure if there was really a 911 call.

And let me notify you about the fact that every cartype exists many times. You may or may not see a Phoenix everyday, but there are still many of them on our world. I was not in that stolen Phoenix, understand it already.

I would like to have some questions answered before going foward with the investigation.



Luke was there any description on the man? and did you fail to read the man's Miranda rights once in custody? Also I want everysingle evidence you have on which you based your assessment on this situation.

Mr. Padres I would like a copy with a time and date of the receipt from the car rental service and a statment from the person that rented it to you.
Mr. Padres I would also like you to inform officer Pedro to make a statement regarding officer Luke's approach towards you.

I only want this questions answered.

here I am providing you a legitimate copy of the receipt from the Rental Company. Unfortunately I cannot provide you a statement of the representative who brought me the car though, I can't seem to find his details anywhere.

Good afternoon.

I was patroling around Market when I've heard a car alarm. After locating the sound, I procceed to pull over the driver, so I could ask him what has happening. (He got suspected, but I can't remember who suspected him)
Moments later Supervisory Officer Luke arrived on scene (Padres was suspected already) and parked his car infront of Padre's car.
After parking his car, Supervisory Officer Luke ran to Padre's car, opening the door, taking Padres to the ground and cuffing him.
I do not know if he was using force because I staid in cover behind my car.

I have contacted the rental services and talked with Maria Wolfenstein, an employ at the rental service that was able to confirm that there was indeed a service provided to Mr. Padres Rosso, and she also confirmed that the receipt was infact real.




Still waiting for S.Officer Luke Nagington's response to my previous question.

There was a report of the man who I arrested. I did so with force as stated I did this so they did not run and it was all in a rush I did forget to read Miranda rights straight away but if I can recall before hand I do recall reading them on the way to the station though. I have no solid evidence as I just responded on the call and did so with speed. The car was reported stollen the car was gone and I loaches it with the individual in it. If it was reported stolen I recover a stolen vehicle experience tells me they are the suspects

Again you are discriminating me. You don't know the tiniest bit about me and simply go straight ahead "Yeah, there is a description on this car, I think the guy in the car is definitely someone who would evade police". It's really a shame that officers like you, officials who provide an example and are representatives of the SAPD, have to do things like these. Breaking laws just "because they think that he, in this case I, is gonna evade".

Have you ever seen an Police Officer aiming his handgun lawfully at someone in a Traffic Stop just because he is afraid of him evading? Have you ever asked someone for his ID but broke his legs before because you are afraid of him running from you?

And please, don't act like this is the first report against your misconduct. We both know what happened when I was in my trial period in ASID. Don't make me speak it out.

Good Afternoon.



-Alright, Officer Luke saw a vehicle that matched the description of the stolen vehicle.
-Officer Luke spoted the vehicle and suspected the man, seconds before forcing the man in the vehicle onto the ground.
-Officer Luke then went towards LSPD were the Miranda rights were told.
-Officer Luke then investigated the man and then the man, known as Padres Rosso, told him that the car was rented.
-Officer Luke ingnored the evidence provided my Mr.Padres Rosso and finished his investigation.
-Mr. Rosso was then thrown in jail.




EDIT: Also Mr. Rosso keep your problems out of this report, if this officer has done anything to you in the past it stays in the past.



Mr. Rosso and Officer Luke, confirm if this is what happened.

It's a tad different.

First of all I cannot recall Officer Luke reading me my rights officially. Secondly I couldn't even provide evidence. I clearly stated that I have evidence, but Officer Luke did not answer on that. Instead he kept coming up with his 911 reports that I would fit perfectly the description, aswell as I would drive in the same vehicle with the same car alarm and so on. He then finished the investigation and literally pulled me down the cells, which is again excessive use of force. Ofcourse I did not physically resist at that part.

That is correct to the best of my knowledge yes. Also with regards to the 'not allowing the suspect to provide evidence' I felt I had enough evidence to procesucte the individual so i went ahead and did just that. I asked if he could prove the vehicle was rented early on in the investigation and he said no he couldnt remember the delivery drivers name. He states the male dropped the car and left. But now the suspect is saying the individual which he now knows the name off left paper work non of this was mentioned in the interview.

Nowhere I stated the name of the guy who delivered the vehicle, neither did he leave any paper work. The receipt was made before the delivery.

I explained the officer that I had solid evidence, not specifically described as receipt though, that would prove that I am the temporary owner of the vehicle and no, I did not provide it, since I was handcuffed and not given the ability to present said evidence.

Also with regards to the 'not allowing the suspect to provide evidence' I felt I had enough evidence to procesucte the individual so i went ahead and did just that.

By that Officer LukeN is basically saying that he had enough evidence to say that my receipt or also called proof of ownership is considered worthless and ineffective. He admitted that he failed to give me the chance to officially identify myself as vehicle owner.
