State Law Proposal
This document has been written in proposal for an update on San Andreas State Law, I believe it's time we had an update so our Officers can be more effective, I am unsure who passes these laws so I thought it best to be placed in General Discussion, the original laws are included in this documentation, but organized into sections.

Section I. ARPD Rights, Restrictions and Laws
Rules of engagementSection I states the following, an Officer of the Law may use Lethal Force or Warning force should the following conditions present themselves to the given situation.
Lethal Force may be used if:-1A. An Officer or another persons life is in immediate danger.
2A. An suspect is fleeing and may be fired upon after one warning has been issued.
3A. An suspect is heavily armed and poses a lethal threat.
4A. An person is driving towards the Officer or Civilian at an high speed posing a threat to preserving life.
Use of SMG:-5A. An suspect is fleeing in a car, the
passenger in a squad car may drive-by using uzis, not the driver.
6A. An suspect is fleeing in a car, Officer may fire on foot at the wheels using Uzi.
Warning by use of weapon may be used if:- (Aiming)1B. An Officer has reason to believe an person or suspect has a conceled weapon.
2B. An Officer has cornered an suspect and is demanding the suspect to surrender.
3B. An Officer's warnings to stop are ignored and suspect continues to approach or move away.
Unarmed Suspects:-
1C. Should a suspect assault or engage another civilian in fights, batons have to be used to engage the suspect unless clashing with 1-4A or 1-3B.
2C. Resisting suspects may be floored or hit in an leg or arm should they be refusing to comply with Officers arrest.
3C. Refusal to leave an crime scene can permit officers to push (Hit once) an person away from the scene before they are arrested for Obstruction of Justice.
Section I. ARPD Rights, Restrictions and Laws
Standard Issue Arms1. Standard Issue Pistol may be used in any given stated Rule of Engagement other then 1C-2C melee engagement.
2. Standard Issue SMGs (Uzis) may be used should any of the situations be provided:-
- Heavily armed suspect
- Suspect is fleeing in a vehicle - see section I. 5A

Warnings1. Issue one warning upon small breach of a law such as speeding, or refusing to follow Police Orders.
2. Issue final warning upon continued breach of law such as speeding, or refusing to follow Police Orders.
3. Arrest may follow second warning should Officer see fit.

Argonath State LicenseLicenses are not required to drive in the State of Argonath.

Argonath State Speed LimitSpeed limits for the State of Argonath are as follows:-
- 80mph - City Speed limits, includes strips.
- 120mph - Country roads.
- ---mph - Unlimited on Highway roads
Breach of speed limits or wreckless use of speed governing a situation can result in warning, fines, arrest or vehicle being towed.
Section II. Motorized State Law
Dangerous Driving ClassificationThe following classifications permit fines of upto £250 as a maximum, no higher.
1.
Driving on the path: Maximum penalty - endangering life
2.
Ignoring stop signs and not stopping at intersections: Selected penalty
3.
Intentional damage to other vehicles: Selected penalty and repair costs for damaged vehicles to owners
4.
Intentional damage to goverment property, e.g. Lamp posts, post boxes, bus stops, squad cars: Maximum penalty
5.
Accidents: Clear wreckage and discuss penalties, settle agreement between victims.
Section III. General Theft
Auto Theft1. Theft of an automobile can result in arrest, charges for repair for owner.
2. Theft of an squad car can result in arrest, charges for repair.

Personal Item Theft1. Theft of money through pick-pocketing warrents arrest and return of money.
2. Theft of money through scam warrents arrest, return of money and benefits victim court viewing to charge more.
3. Theft of any other personal item results in court warrent, return of item and arrest.

Breaking and entering1. Should an suspect break house property, it warrents arrest for vandalisum (minimum arrest time)
2. Should an suspect then enter after break, warrent for breaking and entering is given (maximum arrest time)
This applys for vehicles and can be listed as a charge under 'Auto Theft', should a suspect change cars during a chase, 'Grand Theft Auto' is listed in place, warrents maximum jail time and repairs for owners should they step forwards, court warrent is also issued.
Section IV. Assault
Degrees1.
First Degree Assault;First degree criminal assault is charged when great bodily harm is inflicted or if the assault with deadly force is committed against a peace officer.
2.
Second Degree Assault;Second degree assault is charged if a dangerous weapon is used as part of the offense.
3.
Third Degree Assault;Third degree assault is charged when a person assaults another and inflicts substantial bodily harm or assaults a minor.
4.
Fourth Degree Assault;Assaulting a police officer may also result in an assault charge if that officer is effecting a lawful arrest or executing any other duty imposed by law.
5.
Fifth Degree Assault;A fifth degree assault is a misdemeanor if it is a first offense punishable by maximum jail sentance. A fifth degree assault may be charged if a person; commits an act with intent to cause fear in another of immediate bodily harm or death; or intentionally inflicts or attempts to inflict bodily harm upon another.
All are punishable by maximum jail sentance and medical care costs should they be required by victim, only issuable after court.
Section V. Civilian Weaponry
Use of Arms and Possession of ArmsIn the United states of Argonath, San Andreas state, every citizen has the rigth to be armed for reasons such as special jobs (bodyguard), self-defence and shooting sports. If a citizen is carrying a weapon in public, he/she must conceal it from the public, otherwise it is an offence and action will be taken.
All weapons available in the United States of Argonath are considered Legal.
1)Basic - Melee Weapons
2)Sel-defence - Handguns
3)Special Jobs - Handguns, Submachine Guns, Shotguns, Assault Rifles
4)Shooting sports - Long Rifles
3.§ Self-defence
In the United States of Argonath, San Andreas state, every citizen has the right to defend him/herself against attackers with using continence.
When the citizen's life got in direct danger, he/she has the right to defend it with using weapons.
-3.§A) Weapons Use Act:
In self-defence situation you must use meele weapons, or hand guns.
Only in these situations you can use other weapons:
- When there are more then one armed attacker.
- When the attacker(s) is/are heavily armed.
(using continence): You must know when you are allowed to use weapons, and what type of weapons.
[eg: You can not shoot down an unarmed attacker with M4.]
The only thing what the citizen can do is to defend him/her life. When the citizen's action turns to assault or homicide, he/she commites crime also.
The killing because of self-defence reason can be consider legal, only in that case, when there was no other way to protect your life.
Every self-defence killing must be investigated by the ARPD.
4. Protecting property
-If you own a building and territory around it (garden,yard,garage,parking lot) , you have every right to protect it from trespassers. If the trespasser(s) stays after asked them to leave, you can call the police or take matters into your own hands.
-If you own a vehicle and someone is using it, you can ask for it back. If he/she refuses to return the car, you can report them for Grand Theft Auto, or you can take matters into your own hands.
Every crimes which counts as Property Protection will be investigated by the ARPD.
Section VI. Gambling
Gambling LicensesCurrent Status:Licenses are an
requirement to host a gambling event, anyone caught gambling intentionaly at an unlicensed gambling vendor such as street gambling is subject to punishment by fines or arrest. Casino's automatically recieve gambling licenses when they are created, Argonath Goverment Officials can give gambling licenses to gambling events
(Administrators), any other form of event is to be considered illegal.

PatentsGambling businesses that have patented an certain game under the Argonath Court of Law are the only establishments that are permitted to use the game, any establishment caught using an patended game for profit can be suspected for fraud and brought to a court of law to be sued if the owner of the patent wishes it to be.

DebtsUnpaid debts or refusal to pay debts to a gambling society or any other money related business such as a bank will result in arrest after multiple warnings, suspect with debt will then be subject to either face court or a goverment official
(Administrator).

D) Multiple prank calls can be dealt with by fines, continuation of a prank call or prank report to police can be punishable by court order and arrest
Section IX. Drug Policy
Promotion of DrugsPromotion of any drug that is not lawfull is punishable by arrest and termination of any found drugs, promotion of drugs can be considered advertising, selling or otherwise. Those found selling drugs must be first processed to find buyers, SAPD Officers then must request a warrent from the Argonath Court of Law to raid the drug users house and arrest the occupents inside by decree of Argonath's Law.
Section IX. Drug Policy
Use of DrugsAny large use of an illegal drug without medical perscription is considered an illegal act and is punishable by arrest, suspects who are believed to have drugs on them are permitted to ARPD Officers searching the premesis of a suspect, and the body and vehicle of a suspect, should drugs be found suspects can immediatly be arrested.

Court WarrentCourt Warrents are issued if the victim of a crime wants to gain fines covering medical costs or otherwise stated in the law, suspects who have court warrents on them are on ''bail'' until a victim states he or she does not wish to press charges for the crime, if they do, they must follow the Argonath Court procedure, posting a court, getting a judge and lawyers and then posting a court date, suspect on bail will then be taken to court, evading court will place extra charges on suspect and most likely cause a suspect to be proven guilty.
Section X. Final Summary
Unlisted lawUnlawfull acts not listed specificly may be related and used should an Officer witness an crime taking place or should a crime be reported, unlisted unlawfull acts are such as 'Prank calls' to the 9-1-1 hot line and are punishable as Officers discuss and see fit for example, unlisted law punishment may be carryed out under authorization of a ARPD Captain or above.
Promotion or possession of drugs is also against the law but unlisted, however immediate warrent for arrest and destruction of the drugs are warrented.
Finally, the following statement must be clear to suspects:
"You are under arrest for <Crime list>, anything you say or do will and can be used in a court of law against you, you have the rights to a fair trial, an attorney and one phone call, you also have the right to remain silent."
This is my idea for an extended Book of Law, the first edition, I could update this as time goes on, but this pretty much would stop any arguements of ''What!? ABUSE!" and so on if approved, I thought it time Officers knew the majority of laws they are to enforce, and how, also why and what rights victims have.
